Rental Terms and Conditions

PREAMBLE

The object of these General Sales Conditions (hereafter “GSC”) is to define the terms and conditions under which sales of holidays offered by ILD-HOMAIR VACANCES via its online shop at www.homair.com Website (hereafter designated “the Website”) are made.

Orders made on the Website constitute the creation of a remote contract which necessarily implies acceptance, without restriction or reservation of these GSC.

These GSC were originally drafted in French.

ILD-HOMAIR VACANCES reserves the right to change them at any time. The new version of these GSC will apply from the time they are put online on the Website for booking holidays.

The Client is therefore invited to regularly update his knowledge of the latest applicable version of these GSC.

These GSC apply to the exclusion of all other conditions.

They may be amended, as appropriate, by special conditions mentioned on the Website.

CLAUSE 1: SITE USE

The Client guarantees to ILD-HOMAIR VACANCES their status as an adult, having legal capacity and having all possible necessary authorisation to use the method of payment chosen on confirming the order.

The Client is authorised to have access and use of the Site with the sole purpose of booking holidays from ILD-HOMAIR VACANCES.

The Client agrees to use this Site in a responsible way and in complete compliance with these General Sales Conditions as well as in compliance with the law and local regulations including import-export regulations. Without exception, no part of the Site content may be used as trademark for a pornographic, illegal, defamatory purpose or in order to damage the public or private life of any person whatsoever, nor to infringe any intellectual property rights, name, brand or service or other intellectual property rights of any person or entity.
The client also agrees not use the Site to develop products or services which could be offensive, illegal, threatening, libellous, menacing, harmful, obscene, malicious, or otherwise reprehensible in any way.

ILD-HOMAIR VACANCES may cancel services provided to any Client found using the ILD-HOMAIR VACANCES services for undesirable or illegal purposes.

No downloading, saving, change, publication or distribution of any part of the Site content whatsoever is authorised or permitted.

The Client is personally liable for use made of Site content.

The Client agrees not to include in the Site content any words, image, design, trademark or any work whose intellectual property rights belong to any third party whatsoever without having first obtained appropriate authorisation from the owners .

When making a booking on the Site, the Client guarantees that he has all rights, permissions and authority necessary to place the order.

The Client accepts personal responsibility for protecting his password and for controlling personal account access and to be personally liable for any booking or other actions made via this account.

The Client is informed that bookings made by telephone or by mail are governed by the General Rental Conditions set out in the ILD-HOMAIR VACANCES company catalogue.

Bookings are made in an individual’s name and are personal. They cannot therefore be the subject of any transfer or partial or full sub-let without prior express agreement by ILD-HOMAIR VACANCES

ILD-HOMAIR VACANCES reserves the right to cancel any booking from a Client with whom there is a dispute relating to the payment of a previous order.
ILD-HOMAIR VACANCES informs its clients that the sale of accommodation services supplied on a defined date or for a defined period is not subject to provisions relating to the 7-day retraction period applicable to remote sales

2.2: Ordering Procedures

Clients placing an order directly on the www.homair.com site shall follow the following procedures

    - upon placing their first order, the Client shall fill in the identification form.  
    - The Client chooses their various holidays and clicks on the “Add to basket “link.

At any time the Client may:

Obtain a summary of the selected holidays by clicking on the “My basket” link

Complete their selection and make a booking by clicking on the “My basket” link

To order holidays chosen the Client shall:

Give identification by entering e-mail and password.

    - Make a declaration of acceptance of all of the General Conditions of Rental, fully and without reservation by ticking the “I certify that I have read these General Conditions of Rental” before confirming the Basket.
    - Confirm the invoicing address

A booking voucher will appear setting out: the user’s contact details, the address of the holiday accommodation, the type, quantity and price of the holidays selected by the Client, possible reductions and the total price for the order and the method of payment chosen.

2.3: Minimum duration of holiday

In high season (02/07 to 27/08) holidays will be a minimum of seven days arriving on a Saturday and a minimum of 10 days arriving on a Wednesday

In low season, there is a minimum of two nights except at the following campsites: Argelès-sur-Mer “La Chapelle”, “La Sardane” and “Les Criques de Porteils”, Bidart, Le Barcarès “Le Floride” and “L’Embouchure”, Marseillan “Nouvelle Floride” and “Charlemagne”, Port-Grimaud, Puget-sur-Argens, Cagnes/Mer “Le Todos”, Canet-Plage, Cap d’Agde, Hyères, La Londe, La Couronne and St Mandrier, for which holidays are a minimum of seven days for the period 1/6 to 2/7 with obligatory arrival on a Wednesday or Saturday.

For holidays of a minimum of two nights, there is the possibility of leaving on a Sunday between 5pm and 7pm when this has been notified at the time of booking (except for the Castellane, Pegomas, Argeles Criques de Porteils, Puget-sur-Argens, Tarascon, Mesland, Bonifacio, Florence, Luz Lagos, Roquebrune, La Palmyre - Atlantique Parc, Platja d’Aro - Cala Gogo et Internacional de Calonge campsites).

CLAUSE 3: PRICES

3.1: Prices

The prices mentioned on the Website at the time of booking are fixed and final. Moreover ILD-HOMAIR VACANCES reserves the right to change its prices at any time. Holidays will be invoiced on the basis of prices in force at the time of booking, subject to availability.

Prices shown are valid for the current season. Unless other mention is made, they correspond to one night and are stated in Euros, including VAT.

Prices include:

• Rental of the equipped accommodation and access to the campsite mentioned on the booking form.
• Water, gas and electricity consumption.
• Access to campsite facilities, in particular facilities and sanitary arrangements as defined in the Website catalogue.
• Parking for one vehicle per rental (at the majority of our campsites)

Prices do not include:

• Holiday and household waste taxes.
• Cancellation guarantee.
• Administration charge.
additional options such as an additional car, a dog (accepted at some campsites) disposable sheets, baby kit, additional tent, (at some campsites) fee paying activities offered by the campsite, bicycle hire, safe hire etc
Cleaning charge of €60, where it has not been carried out by the Client.
Payment of two deposits, one for a total minimum sum of 160 Euros (this varies according to the campsite and is refundable at the end of the holiday). This shall be subject to separate settlement (100 Euros for the deposit and 60 Euros for cleaning charge + guarantee deposits which are specific to campsites) by way of two cheques, two Bank Card payments or in cash.
Transport or consumption costs.

These costs are payable on arrival at the campsite with the exception of the administration charge and the cancellation guarantee and the baby kit; additional services arising from voluntary or involuntary extension of the holiday (early arrival, weather conditions etc) are payable by the Client on the basis of prices in force.

3.2 : Due date for settlement by Bank Card

For all bookings made less than one month before the start of the holiday, the total price shall be paid at the time of booking, that is:

• Administration charge.
    -Cancellation guarantee (optional) –The total holiday price.
For any booking occurring less than two months before the start of the holiday, the payments will be made according to the following due dates:

Upon booking:
    - Administration charge.
    -The cancellation guarantee (optional) -75% of the total rental sum

2. One month before the start of the holiday: 25%, or the balance of the total rental.

For any booking occurring less than three months before the start of the holiday, the payments will be made on the following due dates:

1. Upon booking:
    - Administration charge
    - The cancellation guarantee (optional)
    - 50% of the total rental sum

2. Two months before the start of the holiday: 25% of the total rental sum.

3. One month before the start of the holiday: 25% or the balance of the rental total.

For any booking occurring more than three months before the start of the holiday, the payments will be made according to the following due dates:

1. Upon booking:
    - Administration charge.
    - The cancellation guarantee (optional) -25% of the total rental sum

2. Three months before the start of the holiday: 25% of the total rental sum.

3. Two months before the start of the holiday: 25% of the total rental.

4. One month before the start of the holiday: 25% or the balance of the rental total.

Payment by Bank Card this is the obligatory payment method for bookings less than 15 days before the arrival date.
 

3.3 : Due dates for settlement by Bank Transfer

For any booking made less than three months before the start of the holiday, the payments will be made according to the following due dates:
1. Upon booking:
    - Administration charge.
    -The cancellation guarantee (optional) -100% of the total rental sum

For any booking occurring more than three months before the start of the holiday, the payments will be made according to the following due dates:
1. Upon booking:
    - Administration charge.
    -The cancellation guarantee (optional) -30% of the total rental sum

2. Two months before the start of the holiday: 70% of the total rental sum.

3.4 : Administration charges
Administration
charges are payable by named booking once per season.
There is a standard administration charge of 25 Euros including VAT in the following cases:

    -
payment by bank transfer (overseas Residents only): in one payment
    - payment by bank transfer in instalments (overseas Residents only)
    - payment by Bank Card in instalments (excluding automatic debit)

Administration charge reduced to 10 Euros including VAT in the following cases:
    - payment by Bank Card:
in one payment or by instalments with direct debits

3.5 : General Remarks
In default of payment: In the event of late payment of the balance by more than 10 days, the booking will be cancelled automatically and the terms and conditions set out below will apply.

Pets: Only dogs are accepted (under the terms and conditions of access authorised by campsite reception). In all cases, only one dog is authorised per rental. The additional price payable varies from campsite to campsite and is payable at the site on arrival.

Baby kit: Is to be paid in full with the first instalment.

Exchange voucher: When ILD-HOMAIR VACANCES has registered the balance of payment for the rental, an Exchange Voucher will be sent to the address shown on the booking form or by e-mail and it is essential that it be handed in at the HOMAIR Vacances reception upon arrival at the campsite reception.
Retroactivity: “Partner” benefits and promotions cannot be applied to a booking which has already been paid in full or in part.

CLAUSE 4 : CONFIRMATION & PAYMENT

4.1: Confirmation

Bookings are only binding on ILD-HOMAIR VACANCES when ILD-HOMAIR VACANCES has accepted them

ILD-HOMAIR VACANCES offers traditional family holidays, and the accommodation is specially designed for this purpose.

ILD-HOMAIR VACANCES reserves the right to refuse any booking which would be contrary to this principle, which seeks to get round this principle or on the basis of availability.

The surnames, first names and ages of all participants including babies shall be given at the time of booking.

All inaccurate information shall result in immediate cancellation of the booking. The Client shall personally take part in the booked holiday.

Having read the booking, once all of the information requested has been completed by the Client, confirmation will be made by clicking on the “Confirm” button to finally confirm the booking. The Client has the possibility of paying on the Website by Bank Card. Having confirmed the method of payment and the Client finally confirms the order with the effects mentioned below.

4.2.1: Payments by Bank Card on Site

The Client is redirected to the secure Site of ILD-HOMAIR VACANCES’s partner bank, CREDIT AGRICOLE DU MORBIHAN via its secure platform E-TRANSACTIONS CA.

Bank Cards that are accepted by the Website are: Carte Bleue, Visa, Eurocard, Mastercard.

4.2.2 : Payment at a later date

Where the Client does not wish to pay all or part of his holiday immediately, confirmation of the option on the Website shall be made within a maximum time limit of five days by way of settlement of all or part of the holiday by Bank Card or transfer. In the absence of a response within this time limit, the option will be automatically cancelled without prior notice.

At all events and whatever the method of payment chosen by the Client, ILD-HOMAIR VACANCES will give acceptance of booking upon its confirmation and will inform the Client by e-mail or by any other means, in compliance with the provisions of article L121-19 of the Consumer Code.
 
Confirmation of the booking process is made when the “confirm payment” button is clicked.

The data registered by ILD-HOMAIR VACANCES constitutes proof of all bookings and financial transactions made between ILD-HOMAIR VACANCES and Clients.

The total payable by the Client is the sum indicated on the booking confirmation sent by e-mail by ILD-HOMAIR VACANCES to the Client.
 
In all events, ILD-HOMAIR VACANCES reserves the right to refuse any booking in the event of existing dispute with the Client, of full or partial non-payment of a previous order from the Client, refusal to authorise payment by bank card or by cheque by banking organisations, non-payment or part payment, use of bank card not issued by a British bank. ILD-HOMAIR VACANCES cannot, as a result, be held liable under this heading.

CLAUSE 5 : PRODUCT AVAILABILITY

The holidays offered and prices are valid as seen on Site subject to availablilty.

In the event of non-availability of a holiday that has been ordered and paid for, the Client will be informed. Failing a replacement solution being found and accepted by the parties, a refund will be paid.

Holidays offered for sale are described and presented with the greatest possible accuracy. However errors and omissions may occur in presentation. ILD-HOMAIR VACANCES will not be held liable for these. Photographs and wording illustrating products are not contractual.

CLAUSE 6 : CHANGES, CANCELLATION and GUARANTEES

6.1 : Changes

The Client is the sole contact liable to ILD-HOMAIR VACANCES, in particular with regard to financial liability and more particularly in the event of cancellation or complete or partial changes to the holiday.
All requests for changes to the criteria of bookings shall be made in writing to the following address:

In the event of acceptance by ILD-HOMAIR VACANCES, all changes will be invoiced as follows:

Mobile home changes (where this has been previously accepted by ILD-HOMAIR VACANCES):
    - All changes to a rental category involving an additional cost, will be invoiced at €15 by ILD-HOMAIR VACANCES.
    - In the context of changes to a lower category, ILD-HOMAIR VACANCES will retain the following compensation:
• 10% of the total amount of the holiday where it is in High Season (July/August)
• 30% of the total amount of the holiday where it is in Low Season (Excluding July/August)

Changes to holiday dates (in the event of prior acceptance by ILD-HOMAIR VACANCES) :
    -In the context of extension to a holiday or changes to the dates of a holiday involving an additional cost, the cost of changes will be 15 Euros.

    -In the context of changes in holiday dates, resulting in a decrease in the total payable, ILD-HOMAIR VACANCES will retain the following compensation:
• 10% of the total amount of the holiday where it is in High Season(July/August)
• 30% of the total amount of the holiday where it is in Low Season (Excluding July/August)

Changes to holiday site (in the event of prior acceptance by ILD-HOMAIR VACANCES) :

    -In the context of changes to the holiday site involving an additional cost, the cost of changes will be 15 Euros.
    -In the context of changes in holiday site, resulting in a decrease in the total payable, ILD-HOMAIR VACANCES will retain the following compensation:
• 10% of the total amount of the holiday where it is in High Season(July/August)
• 30% of the total amount of the holiday where it is in Low Season (Excluding July/August)

All other changes will be invoiced at €15

Where a change is not accepted, the Client shall take the holiday under the initial terms and conditions or cancel it. All requests for change occurring 7 days or less before the start of the holiday (the date of receipt by ILD-HOMAIR VACANCES of the letter), will be rejected by right.

Any holiday that has been started is payable in full. No reduction will be agreed in the event of delayed arrival or early departure.

6.2 : Cancellation without quarantee

Where cancellation (the date of receipt of the letter of acceptance by ILD-HOMAIR VACANCES occurs :

More than 60 days before the holiday: 10% of the total cost of the holiday and administration charges will be invoiced.
Between the 59th and the 30th day before the holiday: 50% of the total cost of the holiday and administration charges will be invoiced.
Between the 29th and the 5th day before the holiday: 90% of the total cost of the holiday and administration charges will be invoiced.
Less than five days before the holiday, non-arrival, late arrival or early departure, no refund will be made for the holiday and the administration charge

6.3 : Cancellation guarantee

The cancellation guarantee is a fixed sum of €2.5 per night booked payable upon booking. It is also possible to take out an extension to this guarantee in the context of an interrupted holiday. In this case, the cancellation guarantee is €3.5 per booked night. The cancellation guarantee includes repayment of the charge of the holiday (excluding administrative charge and cancellation guarantee) upon presentation of documents in justification of cancellation in the following cases:

Serious personal accident, serious illness, hospitalisation or decease of the assured (grantee) or of the spouse or of persons designated in the rental contract, their direct descendants or ascendants. By serious illness is understood an alteration in health declared by a qualified medical authority, which forbids the patient from leaving their bed and involving the cessation of all work or other activity. By serious accident, is to be understood an unintentional bodily accident to the victim resulting from a sudden action with outside cause and preventing the victim from independent movement.

Serious damage that has not occurred at the time of entering into the contract, resulting from theft, fire and natural causes, to the principal or secondary residence of the person having made the booking and necessitating their presence on the day of departure.

Prevention from taking possession of the premises rented following the booker’s redundancy or that of the spouse, the booker’s work transfer or that of the spouse conditional upon notification by the employer, that is to say after the guarantee becomes effective.

As a result of natural catastrophes according to Law dated 13/07/1982 or forest fires occurring at the holiday site, resulting in: either the holiday being prohibited, at the site, by the competent authorities throughout all or part of the holiday period; or by deterioration of the premises rented and of the sites such that the client is not able to have normal enjoyment of the environment and the services on which the holiday was based.

Any holiday that has been started is payable in full. No reduction will be agreed in the event of delayed arrival or early departure.

Continuous cancellation guarantee will become ineffective from the start of the rental and will only come into effect where one of the items set out above occurs during the holiday.

Any request for the cancellation of the holiday should be brought to the attention of ILD-HOMAIR VACANCES in writing (registered letter with signature upon acceptance) within 48 hours following the event upon which it is based, only the date of the actual originating fact being taken into account.

CLAUSE 7 : HOLIDAY PROCEDURES

7.1 : Arrival

Upon arrival (between 3 pm and 7 pm), the Client shall:

Report to reception with the printed “exchange voucher”
Pay all taxes and expenses not included in the price.
Pay the damage deposit (100 Euros for the deposit and 60 Euros for cleaning + any deposits that are specific to the campsite).

ILD-HOMAIR VACANCES reserves the right to refuse access to a mobile home to families arriving with a number of participants which is greater than the capacity of the accommodation rented or to families having supplied false information upon booking.

Access to the accommodation may also be refused in the event of disruptive behaviour by the Client that is contrary to the peace and calm of the site.

After registration, the hostess will accompany the Client and hand over the keys to the accommodation, the magnetic card enabling access to the campsite (where there is one) and the inventory list.

It is important that the Client checks the inventory upon arrival. Any claims should be made to an ILD-HOMAIR VACANCES representative within an hour following handover of keys. The representative will make all efforts to quickly remedy the situation. No claim will be accepted later.

ILD-HOMAIR VACANCES can in no case guarantee a precise location for the accommodation chosen. The Client therefore does not have the right to choose the location of the accommodation in advance and no location number will be allocated before the holiday. Only the site, the dates and the type of accommodation are guaranteed.

7.2 : The Holiday

LThe Client undertakes to comply with and have other persons resident at the same accommodation comply with all of the instructions making up the internal regulations of the campsite.

ILD-HOMAIR VACANCES and the campsite, not being hotel keepers, cannot at any event be held liable for losses or theft of personal objects, injury or damage which may occur to holidaymakers or to their property during the holiday.

It may occur that some activities and facilities offered by the campsites which are ILD-HOMAIR VACANCES partners, shown in the catalogue are either cancelled or changed, particularly for reasons of weather or in the event of force majeure, or are not available out of season (excluding July/August). ILD-HOMAIR VACANCES will not be held liable for this.

It should be noted that a fee may be charged for activities, such as access to swimming pools and other activities at certain campsites, such as those marked on the Website and in the catalogue, using a specific icon.

7.3 : Departure

7.3.1 : Times

LDepartures shall be between 8am and 10 am.

The Client may depart on a Sunday between 5pm and 7pm (instead of 10am) in low season (excluding July/August). This offer is not valid for Castellane, Pegomas, Argelès “Criques de Porteils”, Puget sur Argens, Tarascon, Mesland, Bonifacio, Florence and Luz Lagos, Roquebrune sur Argens, La Palmyre “Atlantique parc”, Platja d’Aro “Cala Gogo” and “Internacional de Colonge”.
Warning, This option is not valid from 1st June to 2nd July 2011 at campsites for which bookings are a minimum of seven nights for the period (please see paragraph 2.3 “Minimum duration of the holiday”).
 
To benefit from this free option, it is essential that the Client makes notification at the time of booking (by telephone, on the booking form or at the time of booking) using the offer code available on the www.homair.com Website. Otherwise, the client will not benefit from the offer and must therefore leave accommodation on the Sunday before 10 am.

7.3.2 : Inventory and accommodation survey

On the evening prior to departure at the latest, it is obligatory that the Client contacts reception to carry out a departure inventory.

This meeting is generally set for a quarter of an hour in quarter hour segments between 8 am and 10 am and between 5 pm and 7 pm on Sundays (excluding July/ August and subject to prior notification at the time of booking). As you will appreciate, all families cannot leave at the same time.

In the event that you have chosen to pay cleaning charges, these do not include washing up of crockery and kitchen equipment, all of which shall be left in a normal state of cleanliness.

Otherwise a charge for additional cleaning may be retained.

Similarly, any objects broken, lost or damaged during the holiday will be invoiced or shall be replaced by the Client.

A sum of €60 will be withheld from the damage deposit where the premises are not left in a normal state of cleanliness.

In the event of departure outside of normal hours and where the premises are left in good order, the damage deposit will be sent on at Client’s cost by post as soon as possible.

No objection will be accepted in the event of a departure made without inventory or accommodation survey which has not been verified by a member of ILD-HOMAIR VACANCES staff.
In the event of departure outside of hours provided for, staff will, alone, assess the state of cleanliness of the mobile home.

ARTICLE 8 : CLAIMS

Any possible claim relating to non-compliance of services in relation to contractual undertakings should be made in writing to the manager before the end of the holiday and confirmed in a letter sent to ILD-HOMAIR VACANCES within 20 days following the end of the holiday:

In order to facilitate administration of the case, it is essential that details are sent of the name under which the case has been recorded and the booking number as well as the place and dates of the holiday.

After 20 days no claim will be taken into account.

At all events, ILD-HOMAIR VACANCES liability will be limited to a sum equal to 20% of the holiday price for whatever reason.

ILD-HOMAIR VACANCES will not accept any claim or repayment relating to any non-execution or poor execution of services supplied to the Client, which are attributable to the Client either because of a third party not involved in the service or in the event of force majeure. In the absence of legal provisions to the contrary, ILD-HOMAIR VACANCES will not be liable default by third parties and in particular that of one of its Partners.

ARTICLE 9 : GUARANTEES AND LIABILITY

ILD-HOMAIR VACANCES in all of the stages of accessing the Website, the bookings process, execution or provision of after sales services, has only a duty to use best endeavours.

The Client acknowledges that the information made available is neither complete nor exhaustive and that it is the responsibility of the Client to verify the said information before application, and in particular before completing the booking.

The Client expressly acknowledges that ILD-HOMAIR VACANCES will not be held liable for communication by its Partners or by third parties of false, misleading or erroneous information which may be included in the catalogue or on the www.homair.com Website concerning the campsites and in particular presentation photographs, descriptions, activities, leisure activities, services and dates of opening.

Consequently, the Client acknowledges that ILD-HOMAIR VACANCES cannot be held liable for information and holidays offered on the Site.

Whilst ILD-HOMAIR VACANCES makes its best efforts to maintain the service in an operational state, it can offer no guarantee as to continuity of access to its Website and therefore declines all liability for direct and/or indirect damage caused because of impossibility of access, fully or in part, or which may result from use of the service by an Internet user.

ILD-HOMAIR VACANCES can in no case be held liable for damages resulting from loss of data for which ILD-HOMAIR VACANCES may have been informed of any risk relating to the use or to the operation of the Site or of failure to supply the holiday ordered from ILD-HOMAIR VACANCES including, without limitation, damages arising from error, omission, virus, delay or interruption of services.

In the same way, ILD-HOMAIR VACANCES will not be criminally or civilly liable for consequences resulting from inappropriate use or non-authorised use of the Website or of its content by users or third parties.

The Client assumes full liability for prejudices which may be claimed by third parties.

All of the holidays offered on this Site comply with French legislation in force.

In this respect, ILD-HOMAIR VACANCES will not be held liable in the event of non-compliance with legislation in the country where the holiday occurs.

Photographs and wording illustrating products on offer are not contractual. Consequently ILD-HOMAIR VACANCES will not be held liable in the event of error in any of these photographs or in any of this wording.

ILD-HOMAIR VACANCES will not be liable for any indirect damages arising from this agreement, operating losses, loss of profits, loss of opportunities, damages or expenses.

CLAUSE 10 : APPLICABLE LAW - JURISDICTION

These General Sales Conditions are subject to French law and only the version in the French language will be valid for interpretation.

In the event of dispute, only French courts will have jurisdiction.

In the event that one of the clauses in this contract is null and void and non-existent as a result of changes in the law, regulations or by a legal decision, this will in no event affect the validity of and compliance with these General Sales Conditions.

11.2 : The Completeness of the Contract :

These General Sales Conditions, the legal particulars and the order summary sent to the Client form all of the contractual documents and constitute the whole of the contractual relations between the parties.
